After she was caught writing a message on her desk to her friends with an erasable marker during a lesson, Ms Gonzalez was take to the Dean’s office where the Police were called, was handcuffed and arrested by the Police, suspended from school and was given eight hours of community service.

She and her mother are claiming for violation of her rights and excessive use of force. She said that her ordeal was “traumatising” and that she “broke down” when arrested. Her lawyer told the New York Daily News that this was an overreaction and that he “wants to stop this from happening to other young children in the future”.

The New York City authorities have admitted that the arrest was a mistake, and that the arresting officers should have used better judgement.
